WHAT PROTECTIONS DOES CALIFORNIA OFFER FOR UNDOCUMENTED IMMIGRANTS?
California recently passed the California Values Act, a law that was passed and took effect on January 1, 2018. The law was specifically designed to provide widespread state protections for undocumented immigrants by assisting federal immigration efforts. More specifically, this law establishes statewide non-cooperative policies between state law enforcement officials and federal immigration authorities, which means that local law enforcement agencies are prohibited from the following:
Detaining an individual on a hold request from the federal government unless there is a felony or a warrant.
Asking about the immigration status of an individual, or sharing any information with the federal immigration authorities that is not already available to the general public.
The movement or transfer of undocumented immigrants into federal custody unless the individual is a registered sex offender, or if they have been convicted in the last 15 years of a crime that is one of the listed offenses on California's Trust Act.
